What is the difference between a certificate of conformity and a declaration of conformity?

The certificate of conformity and the declaration of conformity are two forms of mandatory confirmation of conformity, the differences between them are as follows:
1) In the case of obtaining a certificate, the manufacturer shares responsibility for the information included in the document itself and for product safety with the certification body where the conformity assessment document was issued. While upon receipt of the declaration of conformity, all responsibility remains with the product manufacturer (or other person performing the declaration).
2) In case of obtaining a product conformity certificate, the document is filled in on a special letterhead protected from forgery. The product declaration of Conformity is filled out on plain white A4 paper. There are established requirements for the design of this document. As a rule, the certification body provides its clients with sample declarations of conformity for the correct execution of the permit document.
3) When conducting tests to obtain a declaration of conformity of products, the law provides for declaration schemes, when it is enough for the applicant to provide test reports conducted in the manufacturer's own laboratories, i.e. on the basis of their own evidence of product safety. When conducting tests to obtain a certificate of conformity, there are no certification schemes that provide for the use of the applicant's own evidence base (with the exception of scheme 9c).
4) Acceptance of the declaration of conformity can be carried out on the basis of two types of declaration schemes: on the basis of the applicant's own evidence or with the participation of a third party. As a third party, the law allows for the involvement of a certification testing laboratory, where independent testing of product samples is carried out.
5) Certification schemes and declaration schemes are usually different from each other. Most often, when issuing certificates of conformity, there are more permitted certification schemes than when issuing a declaration of conformity. However, even when obtaining a certificate of conformity and issuing a declaration of conformity, production quality certificates (certificates of enterprise management systems) are accepted as additional evidence of product safety and quality.
6) Registration of a certificate of conformity always requires confirmation of compliance with a certain set of standards, which are specified in the Technical Regulations or in the Decree of the Government of the Republic of Kazakhstan, which determine the mandatory registration of a certificate of conformity for a specific type of product.
7) When making a declaration of conformity, the applicant indicates specific regulatory documents in accordance with which the product was manufactured and for compliance with which the conformity assessment is carried out. When issuing a product conformity certificate, this document is entered in the state register of conformity certificates and assigned a unique registration number. The same thing happens with a declaration that is registered in the state register of declarations of conformity. These documents are registered in different registers, with different codification, i.e. they must have different registration numbers.
Certification service in the system of the Eurasian Economic Union (Customs Union)
Certificate of Conformity of the Eurasian Economic Union (EAEU Certificate) — a document certifying the conformity of products with the requirements established in the Technical Regulations of the Eurasian Economic Union/Customs Union, mandatory for the import, sale and use of products in the territory of the EAEU member states (the Republic of Kazakhstan, the Russian Federation, the Republic of Belarus, the Republic of Armenia and the Kyrgyz Republic).
When certifying in the EAEU, you do not need to change to a national certificate.
The EAEU certificate is a sufficient document for the import, customs clearance and sale of products specified in the certificate, unless otherwise specified in the Technical Regulations for these Products.
A certificate of conformity is issued either for a batch of products or for products produced in series.
An applicant for product certification may be a legal entity (or an individual entrepreneur) registered in accordance with the legislation of the EAEU member state, which is a seller (importer) or manufacturer (or a person authorized by the manufacturer who performs the functions of a foreign manufacturer on the basis of a contract, which performs actions on behalf of the manufacturer when these products are put into circulation and liability for non-compliance of products with the requirements of technical regulations of the CU / EAEU).
Certification services in the system of the Republic of Kazakhstan
If we are talking about imported products, this is either a mandatory document for import, sale and use of products on the territory of the Republic of Kazakhstan, if these products fall under the technical regulations of the Republic of Kazakhstan and are not subject to mandatory conformity assessment within the framework of the Eurasian Economic Union( Customs Union), and do not fall under the " Unified List of Products subject to mandatory confirmation of conformity with the issuance of certificates of conformity and declarations of conformity in a single form" and "A single list of products for which mandatory requirements are established within the Customs Union"; or voluntary - for other purposes of the Applicant.

The Certificate of conformity of the Republic of Kazakhstan may be a document for import, customs clearance and sale of products specified in the certificate, if these products do not fall under the technical regulations of the Eurasian Economic Union (Customs Union).

A certificate of conformity is issued either for a batch of products or for mass-produced products.

An applicant for product certification may be a legal entity registered in accordance with the legislation of the Republic of Kazakhstan or a member state of the Eurasian Economic Union or an individual registered as an individual entrepreneur (manufacturer, importer, person authorized by the manufacturer, seller) who provided products for conformity assessment.

The validity period of the certificate of conformity is determined taking into account the chosen product certification scheme, the specifics of the product, its production, the validity period of standardization documents and requirements of technical regulations, as well as the period for which the management system is certified (if this is provided for in the product certification scheme) or the shelf life of the product, but not more than 3 (three) years.
